�An Amendment
To amend title I of the Housing Act of 1949 to authorize
financial assistance for urban renewal projects involving the
central business district of a community i·1ithout · regard to certain
requirements otherwise applicable.
That title I of the Housing Act of 1949 is amended by adding
at the end thereof a new section as follows:
"URBAN RENEWAL AREAS INVOLVING THE CENTRAL
BUSINESS DISTRICT OF A COMMUNITY
"SEC. 118.
(a)
community determines
In any case where the governing body of a
(1) that there exists in the central business
district of such community conditions which (A) impose severe
public, economic, or social liabilities, (B) impair, arrest, or
prevent the sound growth, development, or redevelopment of the
community, or (C) constitute a serious and growing threat to the
public health, safety, morals, and welfare of the community, and
(2) that the undertaking of an urban renewal project in such
district will alleviate or remove such conditions and promote the
public welfare and the proper development of the community, the
Administrator is authorized to extend financial assistance under
this title for such project without regard to the requirements
in sec tion 110 with respect to the predominantly residential
character or predominantly residential r euse of urban renewal
areas.
In contracting for any such project, the Administrator
shall consider the need to plan for, and carry out undertakings
with respect to, a sufficiently large area to accomplish the

objectives of this title, and (i) the necessity for staging the
project undertakings and activities on a functional rather than
geographic basis, (ii) the provision of increased opportunities for
effecting the relocation of displaced individuals and business concerns, and (iii) the greater amount of time that may be required
for achieving such objectives through selective and coordinated
action.
Site improvements and supporting facilities which are
peculiarly appropriate to the revitalization and renewal of the
central business district of the community involved, when provided
by a public body or entity, shall be eligible as part of gross project cost and as a local grant-in-a id in connection with a ny such
urban renewal project.
"(b)
Upon appr oval by t he Secretar y a n d subject t o s uch
co n d i tions as he may determin e to be in th e public int erest , t h e
loc a l
p ublic agency may a c qui r e struc tur e s situa ted i n any u r b a n
r ene wal a rea approved fo r a project unde r subsection (a) whi ch ar e
d e t e rmi n e d to be of unu s u a l s ignifi c anc e f o r histo r ic a l
or other
reasons, restore or rehabilitate t hem, and make a vail able the
restored or r e hab il itat e d structure s t o any n onpro f it c o rp o rat ion
o r ass oc iation, or pub l i c b o dy o r age nc y , f o r p u rchase at fair
value f or nonpr o prietary uses in t he publ i c i n t erest.
"(c)
As used in th i s section, the term 'central business
district' means the administrative, commercial, financial, governmental : and cultural center of a community, including its support ing service areas."
�Need for
Special Legislation for the
Revitalization of
Central Business Districts
B~ enacting appropriate legislatip~:
1.
Providing for planning and carrying out the revitalization of an
entire central business district, to allow for staged renewal on
a functional rather than a limited geographical basis, and to
provide for greater opportunity for the relocation of individuals
and businesses within the area.
2.
Encouraging preservation, restoration and rehabilitation of
historical and other significant structures.
3.
Recognizing that certain public facilities essential to the
central business district should qualify as non-cash grants-in-aid .
The Congress would permit cities to:
1.
Plan for and guarantee the total revitalization of the central
business district so that developers and investors will be
encouraged to participate more readily, thus stimulating maximum
participation by private enterprise with a minimum of public
· acquis i tion.
2.
Stage urban renewal action on a more efficient basis so as to
reduce the time lag between demolition and reconstruction.
3.
Finance its urban renewal and other related activities on a more
efficient and orderly basis.
4.
Increase job opportunities through the revitalization of the
primary employment area.
5.
Strengthen the economic base of the community.
6.
Provide increased cultural opportunities for the community.

�URBAN RENEWAL AREAS INVOLVING
CENTRAL BUSINESS DISTRICTS
People live in urban areas because they seek the combined advantages
which these areas can offer as compared to more sparsely settled areas.
Such advantages include increased employment opportunities, good housing
in attractive neighborhoods, adequate and economical transportation facilities, the cultural and social advantages offered by the great educational
institutions located in such areas, and the crnvenience and enjoyment of
the varied facilities afforded by the central business district. It is the
total urban "package," rather than any special element thereof, which is
the magnet of attraction. It is therefore essential that any national
legislation to assist cities in the renewal of their urban areas should
permit effective assistance to be made available for the renewal of any
blighted or deteriorated sections of an urban community so that any such
section can be redeveloped to provide any one or more of such desired and
needed advantages.
To a large extent, our present national urban renewal legislation
recognizes this principle. In areas of specialized need, such as mass
transportation and such as colleges, universities and hospitals in or near
urban renewal areas, it recognizes that the standards applied must be
different from those applied in residential area projects. In the case of
central business districts, however, this is not the situation. This
could be corrected by granting the necessary flexibility to provide, in
the case of central business district areas, the varied procedures and
treatment required to provide effective assistance for the renewal of such
areas.
It ·is to be remembered in respect of the national urban renewal program that the capital grant "write down" is extended to the community to
enable it to provide, by proper re development, the advantages its citizens
need. The benefit is to the whole community, not to any particular
redeveloper, be he a private entrepreneur providing housing, a medical
institution providing hospital facili ties, a college or university providing any one or more of the wide range of facilities such an institution
must provide, or a department store building a new structure as a part of
the community effort to revitalize its central business district. The
total community benefits by the better housing provided through the
redevelopment of one residential area, just as the total community benefits by the revitalization of a central business district through the
redevelopment of its deteriorated parts.

�Special Legislation for the
Revitalization of
Central Business Districts
The central business districts which constitute the cultural
and economic hearts of cities, the principal tax resources, and
the principal sources of employment in most communities, are
facing increasingly serious problems of decay and congestion.
The
renewal and revitalization of downtowns require a special approach
and treatment not available or possible under existing law, regulations, and procedures.
In order to enable a city to undertake comprehensive progra ms
to strengthen the ability of its central business district to
function effectively, new legislation is required which will:
1.
Recognize that the health of commercial, industrial ,
and cultural functions of central business districts
is essential to a well balanced community.
2.
Permit the Secretary to qualify site improveme nt s a nd
supporting facilities as part of the gross proj e ct
cost a nd as lo c al g r a nts-in - aid .
3.
Allow f o r the acquisition and rehab i litati on o f
hist o ri c al prope r ties in s uch a re as.
4.
Permit waiver of resi d en ti a l requi r e ments in renewing central bu siness district s.

Revitalization of central business districts made possible
by the attached amendment will:
1.
Strengthen the tax base of cities.
2.
Permit the use of the increased local tax resources to
more nearly meet the educational, social welfare,
recreational, and cultural needs of the people.
3.
Improve the economic health of cities.
4.
Increase employment opportunities for unskilled and
semi-skilled in central business districts where the
greatest potential for such employment exists now and
will exist even more so as revitalization is accomplished.
This proposed legislation was introduced in the 88th Congress
as R.R. 6431 and as a part of S. 2031, and was endorsed by:

action on this amendment and offers her support to your Sub-Committee

An Amendment

To amend title I of the Housing Act of 1949 to authorize
financial assistance for urban renewal projects involving the
central business district of a community without regard to certain
requirements otherwise applicable.

That title I of the Housing Act of 1949 is amended by adding
at the end thereof a new section as follows:

"URBAN RENEWAL AREAS INVOLVING THE CENTRAL
BUSINESS DISTRICT OF A COMMUNITY

"SEC. 118. (a) In any case where the governing body of a
community determines (1) that there exists in the central business
district of such community conditions which (A) impose severe
public, economic, or social liabilities, (B) impair, arrest, or
prevent the sound growth, development, or redevelopment of the
community, or (C) constitute a serious and growing threat to the
public health, safety, morals, and welfare of the community, and
(2) that the undertaking of an urban renewal project in such
district will alleviate or remove such conditions and promote the
public welfare and the proper development of the community, the
Administrator is authorized to extend financial assistance under
this title for such project without regard to the requirements
in section 110 with respect to the predominantly residential
character or predominantly residential reuse of urban renewal
areas. In contracting for any such project, the Administrator
shall consider the need to plan for, and carry out undertakings

with respect to, a sufficiently large area to accomplish the
objectives of this title, and (i) the necessity for staging the
project undertakings and activities on a functional rather than
geographic basis, (ii) the provision of increased opportunities for
effecting the relocation of displaced individuals and business con-
cerns, and (iii) the greater amount of time that may be required
for achieving such objectives through selective and coordinated
action. Site improvements and supporting facilities which are
peculiarly appropriate to the revitalization and renewal of the
central business district of the community involved, when provided
by a public body or entity, shall be eligible as part of gross proj-
ect cost and as a local grant-in-aid in connection with any such
urban renewal project.

"(b) Upon approval by the Secretary and subject to such
conditions as he may determine to be in the public interest, the
local public agency may acquire structures situated in any urban
renewal area approved for a project under subsection (a) which are
determined to be of unusual significance for historical or other
reasons, restore or rehabilitate them, and make available the
restored or rehabilitated structures to any nonprofit corporation
or association, or public body or agency, for purchase at fair
value for nonproprietary uses in the public interest.

"(c) As used in this section, the term 'central business
district' means the administrative, commercial, financial, govern-
mental, and cultural center of a community, including its support-

ing service areas."
Need for
Special Legislation for the
Revitalization of

Central Business Districts

 

By enacting appropriate legislation:

ZL.

Providing for planning and carrying out the revitalization of an
entire central business district, to allow for staged renewal on
a functional rather than a limited geographical basis, and to
provide for greater opportunity for the relocation of individuals
and businesses within the area.

Encouraging preservation, restoration and rehabilitation of
historical and other significant structures.

Recognizing that certain public facilities essential to the

central business district should qualify as non-cash grants-in-aid.

The Congress would permit cities to:

Plan for and guarantee the total revitalization of the central
business district so that developers and investors will be
encouraged to participate more readily, thus stimulating maximum
participation by private enterprise with a minimum of public
acquisition.

Stage urban renewal action on a more efficient basis so as to
reduce the time lag between demolition and reconstruction.
Finance its urban renewal and other related activities on a more
efficient and orderly basis.

Increase job opportunities through the revitalization of the
primary employment area.

Strengthen the economic base of the community.

Provide increased cultural opportunities for the community.

URBAN RENEWAL AREAS INVOLVING
CENTRAL BUSINESS DISTRICTS

People live in urban areas because they seek the combined advantages
which these areas can offer as compared to more sparsely settied areas.
Such advantages include increased employment opportunities, good housing
in attractive neighborhoods, adequate and economical transportation facil-
ities, the cultural and social advantages offered by the great educational
institutions located in such areas, and the ccnvenience and enjoyment of
the varied facilities afforded by the central business district. It is the
total urban "package," rather than any special element thereof, which is
the magnet of attraction. It is therefore essential that any national
legislation to assist cities in the renewal of their urban areas should
permit effective assistance to be made available for the renewal of any
blighted or deteriorated sections of an urban community so that any such
section can be redeveloped to provide any one or more of such desired and
needed advantages.

To a large extent, our present national urban renewal legislation
recognizes this principle. In areas of specialized need, such as mass
transportation and such as colleges, universities and hospitals in or near
urban renewal areas, it recognizes that the standards applied must be
different from those applied in residential area projects. In the case of
central business districts, however, this is not the situation. This
could be corrected by granting the necessary flexibility to provide, in
the case of central business district areas, the varied procedures and
treatment required to provide effective assistance for the renewal of such
areas.

It is to be remembered in respect of the national urban renewal pro-
gram that the capital grant "write down" is extended to the community to
enable it to provide, by proper redevelopment, the advantages its citizens
need. The benefit is to the whole community, not to any particular
redeveloper, be he a private entrepreneur providing housing, a medical
institution providing hospital facilities, a college or university pro-
viding any one or more of the wide range of facilities such an institution
must provide, or a department store building a new structure as a part of
the community effort to revitalize its central business district. The
total community benefits by the better housing provided through the
redevelopment of one residential area, just as the total community bene-
fits by the revitalization of a central business district through the

redevelopment of its deteriorated parts.

Atlanta's Mayor Ivan Allen, Jr., today made the following
statement with regard to the anticipated arrival here on Thursday
of the participants in the Poor People's March.

"J have asked Mr. Albert Bows, President of the Atlanta
Chamber of Commerce; Dr. Harmon Moore, Executive Director
of the Christian Council of Metropolitan Atlanta; and Chief
Herbert T. jediiee, to serve as a City Coordinating Committee,
to confer at once with officials of the Southern Christian Leader-
ship Conference and local representatives of the Metropolitan
Atlanta Summit Leadership Congress.

"This coordinating committee will secure information
regarding arrival and departure times, march routes and such
requirements as meeting places, housing and food, and then
make recommendations for such assistance as might be needed
from the community.

"The city government will make every effort to provide
adequate city services, and J urge organizations and citizens to

cooperate in this effort,"

WHEREAS, The assagination of Dr, Martin Luther King, Jr.
takes from Atlanta one of its greatest citizens of all time, who honored
his home city in the eyes of al] the world when he was awarded the
Nobel Peace Prize in 1964, and

WHEREAS, this senseless act of violence takes from our nation
one of its greatest leadersof ail time in the cause of human brotherhood
and racial amity, and

WHEREAS, this tragic misdeed takes from our world one of its
greatest advocates of the cause of peace among all nations and all
races, and

WHEREAS, although the physical presence of this eminent American
has been torn from us, his soul will go marching on to in spire all
Americans to achieve the goal of equal justice, equal opportunity and
equal citizenship for each and every American, regardless of race,
creed or color, and

WHEREAS, our Atlanta citizenry joins with all men and wornen of
good will everywhere on our earth, and particularly with the good
citizenry efx in our sister city of Memphis, in deploring the deadly
shot whose echoes of hatred resounded around the world and in one
tragic instant transmitted a living leader of our present to a martyr
of ages to come,

NOW, THEREFORE, I, Ivan Allen, Jr., Mayor of the City of
Atlanta, do hereby proclaim Monday, April 8, as

MARTIN LUTHER KING, JR. DAY OF MOURNING
and call upon all citizens to observe that day in honor of the memory
of our eminent fellow citizen and to join with me in praying that, with
God's help, our nation may attain the goal of complete racial justice
and racial equality for which he gave his life.
