Dear George:
Miss Jimmie Mims, Recreation Division, has furnished a list of
eight playlot sites that would be suitable for permanent development.
These sites were selected from the standpoint of good past
participation as well as potential attractiveness and ease of
development.
I have visited all of the sites and selected what I considered
the bes t four. The four sites were then referred to the Land
Agent for a rough cost appraisal which amounts to a total of
$69,000.00 (The Angier and Parkway site had to be discarded as

Dear George:

In my recent letter to you I was somewhat concerned as to

the possible land acquisition costs for three playlot sites.
In the past few days I have uncovered two pieces of property
that could very well be developed into useful and attractive
playlots. One is a property already dedicated to the Parks
Department in the West End Urban Renewal area located at White
Street and Rose Circle. The other is located in the Lincoln
Homes area which would be dedicated to the City if develop-
ment was assured. Thus, no land costs would be involved, and
if spare funds were left over after development, maybe a less
expensive property could be bought such as the Peoples Street
property, tentatively appraised at $6,000.00. We have already
received requests to develop the first two as they would serve
heavily populated neighborhoods.

As I previously mentioned, we would endeavor to design and
construct the playlots to serve as models for a future city-
wide playlot construction program, including such items as
landscaping, hard surface courts, lighting, as well as protec-
tive walls or low fencing where playlots abut streets.

We are really anxious to design and build some playlots where
we are not hamstrung for lack of funds.

To begin with, I have before me the contract between R &amp; G
Construction Company and the City of Atlanta dated November 25,
1968, which covers the subject matter of the letter.

The contract is silent on the specific subject of the inquiry
raised in the letter, although certain portions of the general
conditions (paragraphs 11, 12, 17, 18, 20 and 22) support the
proposition that the Contractor is entitled to no additional
compensation.

Inasmuch as there are no Georgia cases specifically on the point,
we must refer to the general law to determine whether or not

the facts set forth in the letter are sufficient to either (1)
authorige the Contractor to take the position that there is an
impossibility of performance of (2) to authorize additional
compensation for the Contractor,

To begin with, ". . . (1)t hae generally been deemed clear that
any unprecedented flood or sudden inundation which no human

power could stay and no foresight or prudence could anticipate

is an ‘act of God.’ * 1 Am Jur 2d p. 680. Therefore, there is
some question in my mind as to whether or not this is in fact

an act of God, Im addition to the above general proposition of
law, there is another legal proposition which I feel is presented
in this case and which answers the question adversely as to the
position of the Contractor. This proposition is as follows:

“The question whether nonperformance is excused or
the person who must bear the loss where parformance has
been made more difficult or expensive by an act of God
must be distinguished from the question whether nonper-
formance is excused where performance is made impossible
by such cause. Where an dnconditional contract is te do
a thing which is poesible in itself, the nonperformance
is not excused by an act of God, Performance of an
express contract is not excused by the occurrence, after
the contract was made, of an unforeseen event beyond the
control of the contracting party except when the unfore-
seen event renders performance of the contract impossible.

 
Accordingly, even in a jurisdiction where an act of God
may excuse the nonperformance of a contract, it must
appear, to bring the case within that principle, that

the thing to be done cannot by any means be accomplished."

I am answering this question in a legal context; however, I
feel that there might be some area here for equitable adjust-
ment. To this end, I am requesting that you contact the
architect, lay the problem before him and ask him what
normally is done in similar circumstances,

called off the job and transferred to other areas until

Thi s action wa s the result of a recommendation by C. M.
Al exander , Jr., City Arbori st . The office of the City
Arborist feels that by October 1, 1969 the tree foliage
will have fallen from the trees s ufficiently so that no
damage will resu lt to any tree foliage if construction is
continued.

Due to numerous complaints from the citizens located on
Peachtree Hills, Ray Nixon and Dan Johnson have ordered
that the street crews now working on Peachtree Hills be
called off the job and transferred to other areas until
October 1, 1969.

This action was the result of a recommendation by C. M.
Alexander, Jr., City Arborist. The office of the City
Arborist feels that by October 1, 1969 the tree foliage
will have fallen from the trees sufficiently so that no
damage will result to any tree foliage if construction is
continued.

In our efforts to save street tree beauty throughout the
City of Atlanta, we feel that this action will greatly
help the situation.

the principal emphasis will be for those officially announced candidates

This event will be promoted as the last chance to publicly speak with
the mayoralty candidates and ask them questions. It will primarily be a
question and answer forum. Also, we plan to promote the importance to
the Atlanta Area of this election with particular accentuation of the individual's responsibility to his city government.

I talked with Mr. Fred Shepherd, the: City Architect,
on July 2. Mr. Shepherd stated that he was extremely

and he would make every effort to go out to said
location and make the necessary observations in an
effort to make some appraisal of the needed repairs
and possibly some renovations.

I have been in constant contact with Mr. Albert
Tonsill,.the Center Director, and we, of course,
are vitally interested in securing the center for
additional room for the recreation program.

At the present time, Mr. Tonsill and I believe’
that the remodeling and repairs will not amount
to a great deal of money. Of course, we realize
that it is difficult to estimate costs at the present
going rate.

At such time as I am able to have Mr. Shepherd ‘
go out to the location, I will notify you of our
findings.

Dear Mies Kelley:

Thank you very much for your letter of June 6, 1969,
which has just been received.

We are working under virtually emergency conditions
attempting to meet the critical recreation needs for
the summer here in Atlanta. Every available man

and every piece of equipment is well scheduled several
weeks in advance and the only way I wonldtbenable to
beautify the southeast corner of the above intersection
would be to divert our efforts from the disadvantaged
areas of the City. This is to in no way to suggest
that I don't look with favor upon your request. My
maintenance superintendent however, is quite concerned
as to whether or not once we beautify this particular
location if we will be called upon to renovate all

the vacant properties which are pending development

as part of the Stone Mountain Freeway. Our cwews are
very limited and we must assign priorities to every
project undertaken.

Iam sorry to have to be so negative about this matter
and it is personally very flustering to me that we

can not immediately accomdate you since we do have a
beautification program underway,

My dear Mr. Mayor:

Sometimes I walk around the lake in
Piedmont Park. It is a beautiful park,- if you look
heavenward and see all the gorgeous trees. But if you
look on the ground or at the edges of the lake, the
aspect is revolting. I wish you had taken a walk
around the lake yesterday as I did. “America the Beau-
tiful": is that a laugh!

But it could be beautiful, Mr. Mayor, just as our
government reservations and many foreign countries are.
The difference hinges on one little word: DISCIPLINE.

For goodness sake get our park policemen trained to
catch the pigs in the act of desecrating our recreation
areas and see that some worth-remembering stiff fines
are meted out. If there is any resistance let the
police know they'll be backed up if someone is hurt.

Yours for at least a few spots in town which are
unpolluted by the characters that use them.
