completed by the Department of Finance and that Mrs.
Linda Anderson would probably be the p e rson to handle
this . We were unable to arrange a meeting with Mrs .
Anderson prior to her l eaving on vacation the last
week in July and first week in August . On the first
day of her return on August 11, 1969, we met with
Mrs . Anderson in the Department of Finan ce . She was
familiar with the s e new form s and a g re e d that the
Departme nt of Finance would h andl e thi s typ e of report
for all departments regarding Federal grants. She had
a l ready been in touch with Miss May concerning other
grant prog rams and new reporting forms . It was decided
that we should work clo s ely with Mrs . Ander s on in keep i n g

Dear Dan:

I have read a copy of your letter of August 8, 1969,
to Mr. Charles L. Davis regarding a request from HUD.

On or about June 30, 1969, we received a form letter
dated June 17, 1969, addressed to all agencies parti-
cipating in the Open Space Land Program. Enclosed

with the letter were HUD Handbook No. 1970.8 and

several forms entitled "Combined Cost Control and

State of Accountability". The letter stated that

this was a new report that would be required by HUD
semi-annually on all open space projects in the future.
All reports should be sent to HUD within 10 days
following the reporting period and the first reports
were to be for the six months ending June 30, 1969.

Mr. Carl Ryals and I immediately contacted Miss Patricia
May in the office of Mr. Thomas Armstrong. Miss May

is our liaison with HUD for all open space land projects.
We talked with Miss May and others in Mr. Armstrong's
office at length regarding these new forms in an effort
to determine how they were to be completed and exactly
what information HUD needed. The new reporting forms
were also new to the HUD Regional Office and Miss May
stated that we did not need to worry about the deadline
for this first reporting period since she realized that
we would need some time to set up procedures for handling
the reporting forms.

Mr. Ryals and I determined that the forms should be

May again on August 8, 1969, and advised her that we

were going to meet with Mrs. Anderson to work out a
procedure for handling the reports. At that time,

Miss May again reiterated that they understood our problems
since the forms were new and that we didn't need to worry
about not getting them in on time this first reporting period.

Apparently, Mr. Thomas Armstrong was not aware that we had
been in touch with his office regarding these forms.

We will assist the Department of Finance in every way
possible in order to complete these forms and get them
to the HUD Regional Office.

Subject: Attached Letter from Paul Weir

Jimmy Mims says that normally the industrial firm that sponsors the
championship softball team in the Softball Association paid for the cost

of the trip to the National Tournament in the event their team wins the

metropolitan championship. Jimmy is Commissioner of the Softball
Aeecciation and says that the Association is providing $550 toward the
expense of the Water Department Championship team. This money
comes from registration fees, which the teams pay to participate in
league play. The Finance Department says that the only account which
could legally contribute to the expenses of the team is the Mayor's
contingency fund. While eechasévto be very careful not to abuse the
Mayor's contingency fund, I believe that it would be appropriate to
provide some assistance to this team from the City. I would recommend
that the City contribute $500 from the Mayor's contingency fund to be
used to help defray part of the expenses for patticipation in the National
Championship Tournament,

Subject: Attached Letter from Paul Weir

Jimmy Mims says that normally the industrial firm that sponsors the
championship softball team in the Softball Association paid for the cost
of the trip to the National Tournament in the event their team wins the
metropolitan championship. Jimmy is Commissioner of the Softball
Aesociation and says that the Association is providing $550 toward the
expense of the Water Department Championship team. This money
comes from registration fees, which the teams pay to participate in
league play. The Finance Department says that the only account which
could legally contribute to the expenses of the team is the Mayor's
contingency fund. While wechavbvto be very careful not to abuse the
Mayor's contingency fund, I believe that it would be appropriate to
provide some assistance to this team from the City. I would recommend
that the City contribute $500 from the Mayor's contingency fund to be
used to help defray part of the expenses for patticipation in the National
Championship Tournament.

Cne of our Atlanta ‘later Department softball teams won the Metropolitan
Area Industrial Slow Pitch Softball chamnionship after havins sucessfully
won ‘the City League title.

The National championship tournament for slow pitch softball teams will be
held in Charlotte, i}. C. August 29, 30, 31, and September 1. Our team has
been invited to represent the Atlanta Metropolitan area,

The estimated expenses for this trip are as follows:

Traveling expenses - 4 cars - approximately 900 miles each car - $ 250.00

You have rendered a legal opinion stating that we do own half the
property, and your opinion has been substantiated by a legal opinion
rendered to Mr. Paul Ivey by Mr. Ralph Jenkins, of your office. The
County Attorney ha s advised me that he is in the process of selling
this property to a priva te individual for its recently appraised
value of $85,000.00 if we don't make up our minds quickly as to what
we intend to do about buying it ourselves. He made it clear that his
position is the City has no int e rest in the property. However,
shortly before Mr. Earl Landers' retirement, Mr. Landers contacted
the County Attorney and apparently worked out an agreement where the
City would have to pay for only half the appraised value. You will
note, among the Xerox copies attached, my copy of Mr. Landers' letter
to Mr. Harold Sheats.
Problem No. 2 involved a small parcel of land adjacent to Bagley Park,
which for years we thought belonged to the City of Atlanta • . Some time
ago, prior to discovering who really owned th e land, my department installed a numb e r of white-way poles which.lie on the property by a
. matter of a few inches. By the time we discovered tha t we did not own
the land, Fulton County let it be known that they were going to widen
Pharr Ro a d. Mr. Paul Ivey, our Land Agent, r e ached an agreement with
the County whereby the County would buy this private property, generally
known as the "Ne lson property," and would take off the front of it tha t
which they need e d for the widening of Pharr Road, then would transf er
this property to the City of Atl anta at the ir net cost. In turn, the
City ~ould tran s fer to the County the front a ge of Bagley Pa rk, also
needed for the wide ning of Pharr Ro a d. The n e t results of this transaction would be that th e City of Atlant a would pay to Fulton County
app"ro x ima t e ly $2,500.00. Ever since 1964 Mr. Ivey has be en making
repeated efforts to get Fulton County to go ah ead and prepare a deed to
transfer the "Ne lson property" to the City. Mr. Ivey has let it be
known that the City is r ea dy to buy th e property; However, Mr. Ivey
reports that h e has been put off on nume rou s occasion s by variou s r e pre·sentative s of the County. The County h a s now cont a ct ed Mr. Ivey and is
asking, nWhy in the world doesn't the City go ahe a d and buy it, :i and
have now plac e d the value at $3,500.00. The County's representative
says that the land is now worth that amount and, if we wish to buy it,
that is what it is going to cost us.
Thrown into this is a small and rather minor situation where the County
desires to acqui r e fro m the City what we call the Sanely Creek Park Site
in Northwe st Atl ant a . The County ne ed s the l a nd to expand th e ir cl ear
zone fo r th e Fulton County Airport. We are perfectly willing to accommo dat e Fulton Coun ty in s e lling them Sandy Cre ek Par k Site at th e appra is ed
value so that they might exp and th e runways . The prop e rty wa s dee de d to
the City of Atl ant a with a numb er of r es trictions and ea s ements and is
in the flood pl a i ns ; there f ore we wou l d not be lo s ing any p ar ticul arly
v a lua bl e p i ece o f park pr ope rty .

What the City of Atlanta would like to do is to purcha s e from Fulton
County their half of the Adamsville/Health Recreation property for
app;oximately $42,500.00, to pay them appro x imately $2,500.00 for
the "Nelson property" adjacent to Bagley Park, and to sell the County
the Sandy Creek Park Site for its Apprais ed value. What the County
apparently proposes to do is to sell the City Adamsville for $85,000.00,
the "Nelson property" for $3,500.00, and to pay the City the exa ct
appraisal for the Sandy Creek Park Site property.
It is the opinion of the Parks Committee of the Board ·of Aldermen that
every possible effort h as been made to settle the above in a friendly
and fair manner and we wish to do nothing whatsoever that would disrupt
friendly relations between our sister government. However, the Parks
Committee apparently has grown quite weary of the discussions and
problems arising from these transactions and has instructed me to proceed to turn the ma tter over to you to be settled from the legal standpoint,
Alderman Leftwich has expressed a willingness on his part to go with
you to Fulton County and attempt to settle this ma tter; however the
Parks Commi tt ee is so disguste d with the whole affair that they would
be perfectly happy to let the courts de cide the Adamsville and Bagley
situation. App a r ently, at this point, we are unde r no legal comp ulsion
to sell th e Sandy Creek Park Sit e to Fulton County .although possibly
they h ~ve the right of cond emna tion in the expansion of the ir public
airport.

Dear Ferrin and Tom:

This letter concerns a problem we are having with Fulton County
involving certain County and City property known as the Adamsville
Health/Recreation Center, and dlso land now owned by Fulton County

of the overall package, this letter also concerns an undeveloped
park site in Northwest Atlanta, known as the Sandy Creek Park Site,
The latter is adjacent to the Fulton County Airport.

Let me say at the onset that the Parks Committee is aware that

‘Mr. Choyce is the Attorney assigned to the Parks Department, but

they feel since considerable amount of research apparently was done
by Mr. Mathews in rendering a decision concerning Adamsville, that
this letter should be addressed to both of you gentlemen,

I am enclosing Xerox copies of the entire Adamsville, Bagley, and
Sandy Creek Park files, I have asked my secretary to place these
copies in chronological order and, to further simplify the matter, I
have attempted to extract from the Adamsville file all the pertinent
information as to who said what, and when, It is included as an
enclosure to this letter,

To summarize the Adamsville Health/Recreation Center situation, there *
exists at 3404 Del Mar Lane, S. W., a small parcel of property which
contains two buildings connected by a breezeway. One of the, buildings
is a recreation center operated by the City of Atlanta ever since the
Plan of Improvement. The other is a now recently vacated Fulton County |
Health Clinic. We contend that we already own half of the property--
namely, the Recreation Center, and would like to acquire the other
half from Fulton County at some reasonable value, Fulton County
generally claims that we have no interest in this property because of
a twenty-year covenant placed on it in 1949 to secure Federal and
State Health money, said covenant expiring in 1969, Note that the
covenant was placed on the property prior to the Plan of Improvement,

You have rendered a legal opinion stating that we do own half the
property, and your opinion has been substantiated by a legal opinion
rendered to Mr. Paul Ivey by Mr. Ralph Jenkins, of your office. The
County Attorney has advised me that he is in the process of selling
this property to a private individual for its recently appraised
value of $85,000.00 if we don't make up our minds quickly as to what
we intend to do about buying it ourselves. He made it clear that his
position is the City has no interest in the property. However,
shortly before Mr. Earl Landers' retirement, Mr. Landers contacted
the County Attorney and apparently worked out an agreement where the
City would have to pay for only half the appraised value. You will
note, among the Xerox copies attached, my copy of Mr. Landers' letter
to Mr. Harold Sheats.

Problem No. 2 involved a small parcel of land adjacent to Bagley Park,
which for years we thought belonged to the City of Atlanta. .Some time
ago, prior to discovering who really owned the land, my department in-
stalled a number of white-way poles which.lie on the property by a
matter of a few inches, By the time we discovered that we did not own
the land, Fulton County let it be known that they were going to widen
Pharr Road. Mr. Paul Ivey, our Land Agent, reached an agreement with
the County whereby the County would buy this private property, generally
known as the "Nelson property," and would take off the front of it that
which they needed for the widening of Pharr Road, then would transfer
this property to the City of Atlanta at their net cost, In turn, the
City would transfer to the County the frontage of Bagley Park, also
needed for the widening of Pharr Road, The net results of this trans-
action would be that the City of Atlanta would pay to Fulton County
approximately $2,500.00. Ever since 1964 Mr. Ivey has been making
repeated efforts to get Fulton County to go ahead and prepare a deed to
transfer the "Nelson property" to the City. Mr. Ivey has let it be
known that the City is ready to buy the property, However, Mr. Ivey
reports that he has been put off on numerous occasions by various repre-
sentatives of the County. The County hasnow contacted Mr. Ivey and is
asking, "Why in the world doesn't the City go ahead and buy it,* and
have now placed the value at $3,500.00. The County's representative
says that the land is now worth that amount and, if we wish to buy it,
that is what it is going to cost us,

Thrown into this is a small and rather minor situation where the County
desires to acquire from the City what we call the Sandy Creek Park Site
in Northwest Atlanta. The County needs the land to expand their clear
zone for the Fulton County Airport. We are perfectly willing to accommo-
date Fulton County in selling them Sandy Creek Park Site at the appraised
value so that they might expand the runways. The property was deeded to
the City of Atlanta with a number of restrictions and easements and is

in the flood plains; therefore we would not be losing any particularly
valuable piece of park property.

What the City of Atlanta would like to do is to purchase from Fulton
County their half of the Adamsville/Health Recreation property for
approximately $42,500.00, to pay them approximately $2,500.00 for

the "Nelson property" adjacent to Bagley Park, and to sell the County
the Sandy Creek Park Site for its appraised value. What the County
apparently proposes to do is to sell the City Adamsville for $85,000.00,
the "Nelson property" for $3,500.00, and to pay the City the exact
appraisal for the Sandy Creek Park Site property.

It is the opinion of the Parks Committee of the Board of Aldermen that
every possible effort has been made to settle the above in a friendly
and fair manner and we wish to do nothing whatsoever that would disrupt
friendly relations between our sister government. However, the Parks
Committee apparently has grown quite weary of the discussions and
‘problems arising from these transactions and has instructed me to pro-
;ceed to turn the matter over to you to be settled from the legal stand-
|point,

| Alderman Leftwich has expressed a willingness on his part to go with
;you to Fulton County and attempt to settle this matter; however the
\Parks Committee is so disgusted with the whole affair that they would
ibe perfectly happy to let the courts decide the Adamsville and Bagley
situation, Apparently, at this point, we are under no legal compulsion
to sell the Sandy Creek Park Site to Fulton County although possibly
they have the right of condemnation in the expansion of their public
airport.

Subject: Demilitarized Surplus Aircraft, City of Atlanta Playlot
(Your Letter, March 13, 1969)

Dear Mr. Delius:

Thank you for the copy of your letter to the Military Aircraft
Storage and Disposition Center (MASDC), Davis Monthan AFB,
Arizona 85707. Please note the enclosed letter from MASDC and
the brochure provided by the Center on detailed instructions
for the acquisition, disassembly, and transportation of a
donated USAF aircraft.

Regarding the F-86F series aircraft which Colonel R. P. Collins
identifies in his letter as being available in Arizona, I believe
that you would find this single-engine jet fighter suitable for a
playground. Also, since the Georgia Air National Guard at Dobbins
AFB previously operated the F-86D aircraft, their maintenance per-
sonnel should be able to assist in the handling of an F-86F. This
leads to considering the Georgia Air National Guard, namely the
116th Military Airlift Wing (ANG) to allow Brigadier General
Thompson time to arrange for use of ANG airlift for this civic
project. The State of Georgia, as well as the City of Atlanta,
should receive favorable publicity along with Georgia Tech in
this overall project.

I am enclosing a copy of this letter which you may want to provide
to Mr. Dan Sweat in his capacity as Director of Governmental Liaison
for the City of Atlanta.

Mr. Song moved to Atlanta in 1964 a nd has taught judo to
the Georgia State Patrol and U. S. Federal Marshalls.

Dear Mr. Leftwich:

Pursuant to the several converstions you have held

with the undersigned, along with the interest expressed ,
by Mayor Ivan Allen, Jr., I asked Miss Dorothy Yarbrough
of our Recreation Division to compute as accurately

as possible the cost of operating our resident camp and
the wilderness camp at Lake Allatoona. I have taken

the liberty of xeroxing her response which includes a
breakdown for cost per resident camper at $42.35 for a
five day period and a cost for wilderness resident
camper of $28.20 for a five day period.

I have discussed very thoroughly with all the Recreation
Supervisors the opinions expressed by you and Mayor Allen
as to the expenses involved in operating a camp, parti-
cularly one that is some forty-five miles from City Hall.

I have made the suggestion that possibly we should increase
the number of participants and lower the duration of stay
in’order to reduce the per camper cost. I still feel

there is some merit in this suggestion; however, the
supervisors representing the five areas of Atlanta without
exception state that citizens in their areas of Atlanta
were very pleased with the five day schedule and would
prefer it not to be reduced.

F We are carefully avoiding the expenditure of any City
funds for anything other than absolute basic maintenance
and upkeep at both our camping facilities. We have
however, included in our 1969 proposal to EOA provisions
for camping. It seems that OEO in Washington places
great emphasis on camping experience and since we have
conducted this program with Federal funds for the last
several years, I feel it in the best interest not to
remove it during 1969.
