"Be it resolved by the General Assembly of Georgia:
"Section 1, Article II of the Constitution, relating to
the elective franchise, is hereby amended by adding at
the end thereof a new Section to be numbered Section VII
and to read as follows:
"Section VII. Paragraph I. Write-in Votes. No person
elected on a write-in vote shall be eligible to hold office
unless notice of his intention of candidacy was given
twenty or more days prior to the election by the person to
be a write-in candidate, or by some other person or group
of persons gamlified to vote in the subject election, as
follows: Ina state general election, to the Secretary of
State and by publication in a paper of general circulation
in the state; e * ° * es ° e s s e * ° o * . . . e . . * e
e oe . ee e ° o s . . ° * . s . * i * * . e * The Gen=
eral Assembly may enact other reasonable regulations
and require compliance therewith as a condition of eligi-
bility to hold office in this State."
In the General Election of 1962 a similar proposed amend-
ment providing for ten days notice was defeated by a vote of:
FOR 81,935 AGAINST 113,763
as reported on page 845 of Georgia Laws of 1963. ‘The twenty day
limitation contained in the currently proposed amendment is
obviously worse than the ten day limitation contained in the
previously defeated proposal. .The ratification of the current-
ly proposed amendment would seriously impair the "safety valve"
value of the General Election for siuheee "debacles" Sevt
in the Primary Llections or intervening between the same
following General Election,

In the indicated regard this is to request of you an
unofficial opinion in anawer to the following question?
In view of the repeal by Section 34-2001 (nm) of the
(3 Blection Code" (Georgia Laws, 1964 Extra. Session,
pp. 26, 199) of the previous statute loeorgia laws, 1962,
pp. 98, 99) prohibiting the use of atickers, pasters, ete.,
in the casting of write-in votes, ne ee

Sinee a resolution of the General Asseubly of Georgia
(ceorgia Lawe, 1965, pp. 765-~767) has proposed an amend<
ment to the Constitution of the State of Jeorgia, dealing
with the subject matter of write-in voting, and will be
voted upon by the electorate im the eneuing election om
the 8th day of Movember next, the ratification of the same
could possibly be enterpre ' to apply to any write-in
votes that may be cast in such next general election.

being of the conviction that the proscription intended by

Speaker Smith has demonstrated himself te be the best
vote getter of the current eecason ani by the vote that has
been aceoried him in the Democratic run-off primary the
electorate therein has by reason of the circumstances, of
necessity, found him to be well qualified to serve as the
Governor of the State, if called upon for such service.
The writer sincerely believes that voting by write-in
for Speaker Smith for Covernor afforde the best solution
for those Democrats who camot, because of moral conviction,
bring themselves to voting either for a Republican candii-~
date or a candidate whe in an apparent large measure was
saddled the Democratic Party by participation in the
latter's Primary by non-members of the Party.
The action being taken by the writer in the respects
herein is motivated solely from and by his om convictions
and the same is not in anywise prompted from any action on
the part of Spenker Smith other than the imprint upon the
writer of the former*s excellent public service and showing
of his potentialities.

Run-off Primary were indeed masterful and you expressed
my sentiments exactly.

some way just must be found for reversing the moment-

Dear Mayor Allen:
You've been having your hands full lately (don't
you always) but have some satisfaction from
knowing that some of your fellow Atlantans
around the country are mighty proud of the
way you've handled recent TV interviews. And,
frankly, I'm not at all convinced that Mr.
Carmichael's preformance has done anything more
or less than to focus attention on just how
well Atlanta has handled the problems common
to all cities, north and south.
Certainly the incidents have been uncalled for
and granted, the N.Y. Times and Wall Street
Journal have had their fun in their smuggness,
but I can tell you something firsthand. In
my travels around the country this past year
since being transferred to NY (McGraw-Hill
Publishing) I've heard nothing but praise and
wonderment about Atlanta. I don't mean just
regarding the race situation, I mean on a broad
range there is an increasing recognition that
Atlanta just has to be a darn fine place to live
andearn a satisfying and rewarding living.
As. one with deep roots in Atlanta, and a plan
to return one day, it is gratifying indeed
to see the mayor lead as you have.

Dear Mayor,
This letter is to express my appreciation and pride
for what you tried to do in the name of justice and fairplay during the recent racial disturbance in your city. In
one sens e it would seem that you did no more than what a
man in your position would be expected to do, but when it
is taken into concideration that you are a prominant Southern
Gentleman in charge of a large city in the South •••. what
you did is just this side of great.
Not many people would have acted as you did if they
were in your place. What ever your personal views on the
Negro
and his problems matters little. What does matter is
the fact that you saw fit to uphold the duties of yuur
office in the highest tradition. It would be all too easy
in this day and age for you to turn your back on the situation, things being what they are you would have had many
supporters if you had chosen to take a stand of silence.
I realize that a letter of this nature means little or
nothing to a man of your standing. You have more important
things to do than read trivia. But, still and all perhaps
if you receive more such letters from half way across the
continent, you will stand taller and fight harder knowing
that there are a few of us around who back you up.

you made recently concerning the fact that Mr. Maddox has
become the democratic nomineee for State Governor.
While we are not residents of the incorporated limits of the
City of Atlanta, we are residents of Greater Atlanta. We have
tried to help in various ways to make fitlanta one of the fin-
est cities d the world, this in particular by helping in the
Laymen's Movement #4 encourage the integration of our public
schools.
Mrse Rohrer joins me in highest commendations to you our City
Mayor for for speaking out as you did with reference to the

The results of the run-off yesterday for the Democratic
gubernat orial candidate are a disappointment for me and sure ly
a cause for concern for all citizens in thi s community and
state. Fortunately, however , the Democratic primary is no
longer necessarily the equivalent of the election and we still
have a choi ce and chance to keep our state headed in the right
direction. The ch oice between Lester Maddox and Howard
Calloway is one which we cannot afford not making.
You, Sir, are highly respected in this connnunity and ,
f or that reason, I call upon you to take stock of our
situation and to take steps in the direction of preserving
us from Mr. Maddox for the next four years. It would appear
that committees of responsible citizens in Georgia could be

done during the recent racial disturbances.
I am proud to have such a mayor.

glad that you spoke your mind yesterday concerning Lester Maddox instead of the soft shoe
routine demonstrated by the State Office
holders.

I'm sure you are very busy and your schedule

letter. First of all, as a dentist, I commend
your stand on fluoridation. I attended the breakfast at which you spoke at the Marriott during the
Hinman Dental Meeting.

Secondly, your position on our civil rights
problem and your action during our recent trouble
have clinched my respect for you as a man. I'm
not certain that you wer~n't reckless with your
life, though.
Lastly, your statement following the run-off
catasthrope has made my wife and I unswerving admirers and supporters of · yours from here on in.
The man has to be a fool, but a dangerous fool,
and must be stopped someway. Please put my card
somewhere, and if you need any kind of help, just
call.
