Re: Adamsville Health Center
Dear Mr. Ivey:
This will acknowledge receipt of your letter of July 10 concerning
the property in Adamsville that is being used as a recreational
center wheréin you ask for an opinion as to the rights of the City
has in and to that certain tract of land in Land Lot 243 of the
14th District of Fulton County, Georgia, that is currently being
used by the City Parks Department for recreational purposes.
Section 4(a) of the 1951 Ga. Laws at page 3113 provides as
follows:
"The legal title to all real property owned by Fulton County within
the corporate limits of the City of Atlanta as the same may be extended on
or after the date this Act is approved and assigned to or used in
connection with a parks and recreational system on the date this Act
is approved, shall on January 1, 1952 pass to the City of Atlanta
with all rights and appurtenances thereto and subject to all liens
and emcumbrances thereon, unless conveyed by deed to said City of
Atlanta at an earlier date. If no earlier conveyance is made, the
proper authorities of Fulton County are directed in order to clarify
the record title to said property to execute and deliver to the City
of Atlanta on January 1, 1952, or as soon thereafter as practicable,
a deed or deeds containing the legal description of said property, but
such deeds shall not be necessary to effect conveyance of the legal
title."
It would appear to me from the facts that you have furnished that this
property has been assigned to be used in connection with a recreational
system and that legal title to such property passed to the City of
Atlanta on January 1, 1952.
